QUICK FACILITY
Quick Facility participation agreement
Provider: Quick Development Baseball Players Inc
For Circuit Practice, Private Practice, Fielding Practice, High-Speed Analysis and other covered Facility activities. The approved Facility agreement uses “QDBP” as its short name for Quick Development Baseball Players Inc. Here, “Quick Facility” identifies that same provider and distinguishes it from the Academy.
Under 18 · Parent / natural guardian waiver
This Participation Agreement covers activities provided by Quick Development Baseball Players Inc ("QDBP"). Covered Activities include baseball instruction, practices, conditioning, tryouts, camps, clinics, teams, games, tournaments, events, travel, use of fields, facilities and equipment, and related QDBP activities. This Agreement does not apply to QDBP Academy, LLC. Academy participants must complete the Academy’s separate enrollment, contract, and waiver.
10. Acknowledgment of Risks and Assumption of Risk
The Parent/Guardian acknowledges that participation in baseball, training, conditioning, practices, scrimmages, games, tournaments, travel, team activities, camps, clinics, and related events sponsored, organized, or approved by QDBP (collectively, the "Activities") involves inherent and other risks that may result in serious bodily injury, illness, permanent disability, paralysis, emotional distress, property damage, or death.
Such risks include, without limitation, risks arising from throwing, hitting, catching, fielding, sliding, running, strength and agility training, use of bats, balls, pitching machines, weights, exercise equipment, fields and facilities, weather conditions, physical contact with other participants, negligent or intentional acts of other participants or third parties, and transportation to and from Activities.
The Parent/Guardian understands that these risks may arise from known or unknown causes and may occur despite the use of reasonable care, supervision, instruction, equipment, and safety precautions. On behalf of the Parent/Guardian and the student-athlete, the Parent/Guardian knowingly and voluntarily assumes all risks of injury, loss, damage, or death arising out of or related to the student-athlete’s participation in the Activities.
11. Release, Waiver, Hold Harmless, and Indemnification
The parent/guardian understands the inherent risks associated with athletic participation and releases QUICK DEVELOPMENT BASEBALL PLAYERS INC, its owners, coaches, employees, and affiliates from liability to the fullest extent permitted by Florida law.
In consideration for permitting the student-athlete to participate in the Activities, the Parent/Guardian, on behalf of the Parent/Guardian and, only to the extent permitted by Florida law, on behalf of the student-athlete, releases, waives, discharges, and covenants not to sue QUICK DEVELOPMENT BASEBALL PLAYERS INC, its directors, officers, owners, members, managers, employees, coaches, trainers, instructors, volunteers, agents, representatives, independent contractors, sponsors, facility owners/operators, affiliates, successors, and assigns (the "Released Parties") from claims arising out of or related to the Activities and/or the inherent risks of the Activities, including personal injury, illness, death, or property damage, to the fullest extent permitted by Florida law. As to claims belonging to the minor student-athlete, this release is intended to waive no more than the claims that a natural guardian may lawfully waive under section 744.301(3), Florida Statutes, and is not intended to waive claims based on conduct or conditions that are not legally waivable.
The Parent/Guardian further agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees and costs, arising out of or related to (a) the student-athlete’s participation in the Activities, (b) any act or omission of the student-athlete, or (c) any claim brought by or on behalf of the student-athlete or any third party arising from the student-athlete’s participation in the Activities, except to the extent caused by the gross negligence or intentional misconduct of a Released Party.
12. Transportation Authorization and Release
The Parent/Guardian authorizes the student-athlete to be transported to, from, and in connection with practices, games, tournaments, training sessions, camps, clinics, team events, and other Activities by QDBP, its coaches, staff, volunteers, independent contractors, team representatives, or other authorized drivers, or by other parents/guardians or persons designated or approved by QDBP. The Parent/Guardian understands that transportation may occur in privately owned vehicles, rental vehicles, vans, buses, or other forms of transportation not owned or controlled by QDBP.
The Parent/Guardian acknowledges and understands that transportation to and from Activities involves risks, including but not limited to vehicle accidents, collisions, loading and unloading, traffic conditions, weather conditions, driver error, mechanical failure, acts of third parties, and other hazards. On behalf of the Parent/Guardian and, only to the extent permitted by Florida law, on behalf of the student-athlete, the Parent/Guardian knowingly and voluntarily assumes the risks associated with such transportation and releases, waives, discharges, and holds harmless the Released Parties from claims arising out of or related to the transportation to, from, or in connection with the Activities, to the fullest extent permitted by Florida law. Nothing in this paragraph is intended to waive any claim of the minor student-athlete that cannot lawfully be waived, or any claim arising from gross negligence or intentional misconduct.
The Parent/Guardian understands and agrees that the Parent/Guardian remains responsible for timely drop-off and pick-up of the student-athlete unless alternate transportation is specifically arranged, and agrees to provide QDBP with current emergency contact information and any medical, behavioral, or safety information relevant to the student-athlete’s transportation and participation.
13. Medical Authorization and Emergency Care Consent
The Parent/Guardian certifies that the student-athlete is physically able to participate in the Activities or that any restrictions have been disclosed in writing to QDBP. The Parent/Guardian understands that QDBP does not provide medical insurance for the student-athlete and that the Parent/Guardian is solely responsible for obtaining and maintaining health, accident, and hospitalization insurance for the student-athlete.
In the event of illness, injury, accident, or medical emergency involving the student-athlete, and if the Parent/Guardian cannot be reached in a timely manner, the Parent/Guardian authorizes QDBP and its coaches, staff, agents, or representatives to obtain emergency medical care for the student-athlete, including first aid, emergency transport, medical treatment, hospitalization, anesthesia, imaging, laboratory testing, and other treatment deemed reasonably necessary by licensed medical personnel. The Parent/Guardian understands and agrees that all costs associated with such medical care shall be the Parent/Guardian’s sole responsibility, and releases and holds harmless the Released Parties from any claim arising out of the rendering or failure to render such emergency care, except to the extent caused by gross negligence or intentional misconduct of QDBP.
14. Photo / Video / Media Release
The Parent/Guardian grants QDBP and its designees the irrevocable right and permission to photograph, film, videotape, record, livestream, and otherwise capture the student-athlete’s name, image, voice, likeness, performance, and appearance in connection with the Activities, and to use, reproduce, edit, publish, display, distribute, transmit, and otherwise exploit such materials, in whole or in part, in any medium now known or later developed, including social media, websites, advertisements, promotional materials, brochures, sponsorship materials, and fundraising materials, without further notice, consent, compensation, or approval.
The Parent/Guardian understands that such materials shall be the sole property of QDBP and waives any right to inspect or approve the finished product or the specific use to which it may be applied. The Parent/Guardian releases and holds harmless the Released Parties from any claim arising out of the use of such photographs, recordings, or likeness, including claims for invasion of privacy, defamation, right of publicity, or emotional distress, except to the extent prohibited by law.
15. Insurance; No Guarantee of Supervision or Outcome
The Parent/Guardian understands that QDBP may not provide one-on-one supervision at all times and that participation in the Activities does not guarantee athletic improvement, playing time, roster placement, tournament participation, exposure opportunities, scholarships, recruitment outcomes, or any other specific result. The Parent/Guardian acknowledges that the Parent/Guardian is solely responsible for maintaining appropriate medical, accident, and liability insurance coverage for the student-athlete.
15A. Force Majeure; Schedule and Facility Changes
QDBP will not be deemed in breach of this Agreement for a delay, interruption, cancellation, relocation, or modification of services caused by circumstances beyond QDBP’s reasonable control, including hurricanes, severe weather, natural disasters, fire, flood, public health emergencies, governmental orders, facility closures, utility or technology outages, transportation disruptions, labor interruptions, acts of terrorism, civil unrest, or other similar events.
When reasonably practicable, QDBP may respond to such an event by rescheduling sessions, using an alternate facility, adjusting dates or hours, providing make-up opportunities, or otherwise modifying program operations. A temporary interruption or modification caused by such an event does not automatically entitle the Parent/Guardian to a refund or cancellation of payment obligations for the purchased service, except as required by applicable law or expressly agreed to by QDBP in writing. If QDBP permanently cancels a material portion of paid services and provides no reasonable substitute, credit, or make-up opportunity, any refund or credit will be handled in accordance with applicable law and QDBP’s written policies.
16. Governing Law; Venue; Severability
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action arising out of or relating to this Agreement or the student-athlete’s participation in the Activities shall be brought exclusively in a state court of competent jurisdiction located in the county where QDBP’s principal place of business is located, or such other Florida county as QDBP may designate in a separate written agreement, and the parties consent to such jurisdiction and venue.
If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law. This Agreement is intended to be as broad and inclusive as permitted by Florida law.
16A. Mandatory Arbitration
Any dispute, claim, or controversy arising out of or relating to this Agreement, the student-athlete’s participation in the Activities, or the relationship between the parties, whether based in contract, tort, statute, or otherwise, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its then-current Consumer Arbitration Rules, before a single arbitrator located in the county where QDBP’s principal place of business is located. The arbitrator shall have the authority to award the same remedies, including damages and attorneys’ fees and costs as permitted by law.
The Parent/Guardian and QDBP further agree that any arbitration shall proceed only on an individual basis and not as a class, collective, or representative action, and that the arbitrator shall have no authority to consolidate claims of other individuals or to preside over any form of class, collective, or representative proceeding.
16B. Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, IF FOR ANY REASON A DISPUTE DESCRIBED IN SECTION 16A IS NOT SUBJECT TO ARBITRATION OR IS OTHERWISE BROUGHT OR PERMITTED TO PROCEED IN COURT, THE PARENT/GUARDIAN AND QDBP EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE STUDENT-ATHLETE’S PARTICIPATION IN THE ACTIVITIES. EACH PARTY ACKNOWLEDGES THAT THIS WAIVER IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY TO ENTER INTO THIS AGREEMENT.
17. Entire Agreement; Legal Expenses
This document, together with any written booking terms, addendum, or amendment signed or electronically accepted by the parties, represents the entire agreement between the parties regarding the student-athlete’s participation in the Activities provided by Quick Development Baseball Players Inc. Any changes must be made in writing and approved by Quick Development Baseball Players Inc. To the extent permitted by law, the prevailing party in any dispute regarding this Agreement may recover reasonable legal costs and fees.
18. Electronic Signature Agreement
The parties agree that electronic signatures, including signatures completed through DocuSign, have the same effect as original handwritten signatures. The Parent/Guardian agrees that this Agreement may be signed electronically and delivered electronically.
18A. Electronic and Operational Communications
The Parent/Guardian authorizes QDBP to send enrollment, schedule, attendance, payment, safety, transportation, emergency, document, and other operational communications using the email address, mobile number, telephone number, or electronic platform provided by the Parent/Guardian. The Parent/Guardian agrees to keep all contact information current and understands that message and data rates may apply to text messages.
Operational notices sent to the contact information provided by the Parent/Guardian may be relied upon by QDBP as delivered when sent, except where applicable law requires a different method of notice. This paragraph does not constitute consent to receive marketing or promotional text messages where separate consent is required by law.
19. Florida Statutory Notice to Natural Guardian of Minor
NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF QUICK DEVELOPMENT BASEBALL PLAYERS INC USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM QUICK DEVELOPMENT BASEBALL PLAYERS INC IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND QUICK DEVELOPMENT BASEBALL PLAYERS INC HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
20. Acknowledgment and DocuSign Signature Page
The Parent/Guardian certifies that the Parent/Guardian is the parent or legal guardian of the above-named student-athlete, has carefully read this entire Agreement, fully understands its contents, has had the opportunity to review or discuss this Agreement with legal counsel, and signs it freely and voluntarily on behalf of the Parent/Guardian and the student-athlete. The Parent/Guardian understands that this Agreement includes a release of liability, waiver of claims, assumption of risk, indemnification obligations, transportation authorization, emergency medical consent, media release, payment obligations for purchased services, force majeure provisions, and electronic and operational communications terms, and that it is intended to be legally binding to the fullest extent permitted by Florida law.
21. Participation Period and Renewal
The participation period begins at signing and ends 12 calendar months later at the recorded expiry time. A February 29 anniversary falls on February 28 in a non-leap year. The period is limited to the named minor player and Activities actually provided, sponsored, organized, or approved by Quick Development Baseball Players Inc. It does not include Academy enrollment or activities provided solely by another legal entity.
A new acknowledgement is required when this period expires, the player or natural guardian identity changes, the applicable terms change, or the identity of the activity provider changes. Updating contact or emergency contact details alone does not renew or invalidate this acknowledgement. The record must be current on the date of participation. When the player turns 18, adult-player paperwork is required before further participation.
This period controls eligibility for future participation; it does not erase historical signed records, undo releases for past covered activities, or change the separate media release’s provisions concerning previously captured material. The transportation authorization applies whenever QDBP provides, coordinates, or approves transportation in connection with the Activities.
I have read the displayed participation terms, understand the risks and the rights described in them, and have had the opportunity to ask questions or obtain legal advice. I am at least 18 and the minor player’s natural guardian with authority to make this acknowledgement. I voluntarily acknowledge the selected terms and permissions for the named player. I consent to using my typed full name as my electronic signature and to receiving a downloadable electronic copy.

The Participant understands that transportation may occur in privately owned vehicles, rental vehicles, vans, buses, or other forms of transportation not owned or controlled by QDBP.
The Participant acknowledges and understands that transportation to and from Activities involves risks, including but not limited to vehicle accidents, collisions, loading and unloading, traffic conditions, weather conditions, driver error, mechanical failure, acts of third parties, and other hazards. The Participant knowingly and voluntarily assumes the risks associated with such transportation and releases, waives, discharges, and holds harmless the Released Parties from claims arising out of or related to the transportation to, from, or in connection with the Activities, to the fullest extent permitted by Florida law. Nothing in this paragraph is intended to waive any claim of the Participant that cannot lawfully be waived, or any claim arising from gross negligence or intentional misconduct.

A13. Medical Authorization and Emergency Care Consent
The Participant certifies that the Participant is physically able to participate in the Activities or that any restrictions have been disclosed in writing to QDBP. The Participant understands that QDBP does not provide medical insurance for the Participant and that the Participant is solely responsible for obtaining and maintaining health, accident, and hospitalization insurance for the Participant.
In the event of illness, injury, accident, or medical emergency involving the Participant, the Participant authorizes QDBP and its coaches, staff, agents, or representatives to obtain emergency medical care for the Participant, including first aid, emergency transport, medical treatment, hospitalization, anesthesia, imaging, laboratory testing, and other treatment deemed reasonably necessary by licensed medical personnel. The Participant understands and agrees that all costs associated with such medical care shall be the Participant’s sole responsibility, and releases and holds harmless the Released Parties from any claim arising out of the rendering or failure to render such emergency care, except to the extent caused by gross negligence or intentional misconduct of QDBP.
A14. Photo / Video / Media Release
The Participant grants QDBP and its designees the irrevocable right and permission to photograph, film, videotape, record, livestream, and otherwise capture the Participant’s name, image, voice, likeness, performance, and appearance in connection with the Activities, and to use, reproduce, edit, publish, display, distribute, transmit, and otherwise exploit such materials, in whole or in part, in any medium now known or later developed, including social media, websites, advertisements, promotional materials, brochures, sponsorship materials, and fundraising materials, without further notice, consent, compensation, or approval.
The Participant understands that such materials shall be the sole property of QDBP and waives any right to inspect or approve the finished product or the specific use to which it may be applied. The Participant releases and holds harmless the Released Parties from any claim arising out of the use of such photographs, recordings, or likeness, including claims for invasion of privacy, defamation, right of publicity, or emotional distress, except to the extent prohibited by law.

When reasonably practicable, QDBP may respond to such an event by rescheduling sessions, using an alternate facility, adjusting dates or hours, providing make-up opportunities, or otherwise modifying program operations. A temporary interruption or modification caused by such an event does not automatically entitle the Participant to a refund or cancellation of payment obligations for the purchased service, except as required by applicable law or expressly agreed to by QDBP in writing. If QDBP permanently cancels a material portion of paid services and provides no reasonable substitute, credit, or make-up opportunity, any refund or credit will be handled in accordance with applicable law and QDBP’s written policies.
A16. Governing Law; Venue; Severability
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action arising out of or relating to this Agreement or the Participant’s participation in the Activities shall be brought exclusively in a state court of competent jurisdiction located in the county where QDBP’s principal place of business is located, or such other Florida county as QDBP may designate in a separate written agreement, and the parties consent to such jurisdiction and venue.

The arbitrator shall have the authority to award the same remedies, including damages and attorneys’ fees and costs as permitted by law.
The Participant and QDBP further agree that any arbitration shall proceed only on an individual basis and not as a class, collective, or representative action, and that the arbitrator shall have no authority to consolidate claims of other individuals or to preside over any form of class, collective, or representative proceeding.
A16B. Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, IF FOR ANY REASON A DISPUTE DESCRIBED IN SECTION 16A IS NOT SUBJECT TO ARBITRATION OR IS OTHERWISE BROUGHT OR PERMITTED TO PROCEED IN COURT, THE PARTICIPANT AND QDBP EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE PARTICIPANT’S PARTICIPATION IN THE ACTIVITIES. EACH PARTY ACKNOWLEDGES THAT THIS WAIVER IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY TO ENTER INTO THIS AGREEMENT.

Covered Activities are limited to the baseball instruction, practices, conditioning, use of fields, facilities and equipment, and related Academy activities provided to the named minor player through separately purchased Academy services. Participation requires the purchase of the applicable individual lesson, practice, package, or bundle and a confirmed reservation. This waiver creates no annual tuition commitment, full-term enrollment obligation, or automatic renewal.
1. Acknowledgment of Risks and Assumption of Risk
The Parent/Guardian acknowledges that participation in purchased Academy Lessons, individual baseball practices, training, conditioning, and related activities included in the purchased lesson, package, or bundle provided by Academy (collectively, the "Activities") involves inherent and other risks that may result in serious bodily injury, illness, permanent disability, paralysis, emotional distress, property damage, or death.
2. Release, Waiver, Hold Harmless, and Indemnification
The parent/guardian understands the inherent risks associated with athletic participation and releases QDBP ACADEMY LLC, its owners, coaches, employees, and affiliates from liability to the fullest extent permitted by Florida law.
In consideration for permitting the student-athlete to participate in the Activities, the Parent/Guardian, on behalf of the Parent/Guardian and, only to the extent permitted by Florida law, on behalf of the student-athlete, releases, waives, discharges, and covenants not to sue QDBP ACADEMY LLC, its directors, officers, owners, members, managers, employees, coaches, trainers, instructors, volunteers, agents, representatives, independent contractors, sponsors, facility owners/operators, affiliates, successors, and assigns (the "Released Parties") from claims arising out of or related to the Activities and/or the inherent risks of the Activities, including personal injury, illness, death, or property damage, to the fullest extent permitted by Florida law.
3. Transportation Authorization and Release
The Parent/Guardian authorizes the student-athlete to be transported to, from, and in connection with the purchased Activities covered by this Agreement by Academy, its coaches, staff, volunteers, independent contractors, team representatives, or other authorized drivers, or by other parents/guardians or persons designated or approved by Academy. The Parent/Guardian understands that transportation may occur in privately owned vehicles, rental vehicles, vans, buses, or other forms of transportation not owned or controlled by Academy.
The Parent/Guardian understands and agrees that the Parent/Guardian remains responsible for timely drop-off and pick-up of the student-athlete unless alternate transportation is specifically arranged, and agrees to provide Academy with current emergency contact information and any medical, behavioral, or safety information relevant to the student-athlete’s transportation and participation.
4. Medical Authorization and Emergency Care Consent
The Parent/Guardian certifies that the student-athlete is physically able to participate in the Activities or that any restrictions have been disclosed in writing to Academy. The Parent/Guardian understands that Academy does not provide medical insurance for the student-athlete and that the Parent/Guardian is solely responsible for obtaining and maintaining health, accident, and hospitalization insurance for the student-athlete.
In the event of illness, injury, accident, or medical emergency involving the student-athlete, and if the Parent/Guardian cannot be reached in a timely manner, the Parent/Guardian authorizes Academy and its coaches, staff, agents, or representatives to obtain emergency medical care for the student-athlete, including first aid, emergency transport, medical treatment, hospitalization, anesthesia, imaging, laboratory testing, and other treatment deemed reasonably necessary by licensed medical personnel. The Parent/Guardian understands and agrees that all costs associated with such medical care shall be the Parent/Guardian’s sole responsibility, and releases and holds harmless the Released Parties from any claim arising out of the rendering or failure to render such emergency care, except to the extent caused by gross negligence or intentional misconduct of Academy.
5. Photo / Video / Media Release
The Parent/Guardian grants Academy and its designees the irrevocable right and permission to photograph, film, videotape, record, livestream, and otherwise capture the student-athlete’s name, image, voice, likeness, performance, and appearance in connection with the Activities, and to use, reproduce, edit, publish, display, distribute, transmit, and otherwise exploit such materials, in whole or in part, in any medium now known or later developed, including social media, websites, advertisements, promotional materials, brochures, sponsorship materials, and fundraising materials, without further notice, consent, compensation, or approval.
The Parent/Guardian understands that such materials shall be the sole property of Academy and waives any right to inspect or approve the finished product or the specific use to which it may be applied. The Parent/Guardian releases and holds harmless the Released Parties from any claim arising out of the use of such photographs, recordings, or likeness, including claims for invasion of privacy, defamation, right of publicity, or emotional distress, except to the extent prohibited by law.
6. Insurance; No Guarantee of Supervision or Outcome
The Parent/Guardian understands that Academy may not provide one-on-one supervision at all times and that participation in the Activities does not guarantee athletic improvement, playing time, roster placement, tournament participation, exposure opportunities, scholarships, recruitment outcomes, or any other specific result. The Parent/Guardian acknowledges that the Parent/Guardian is solely responsible for maintaining appropriate medical, accident, and liability insurance coverage for the student-athlete.
7. Force Majeure; Schedule and Facility Changes
Academy will not be deemed in breach of this Agreement for a delay, interruption, cancellation, relocation, or modification of services caused by circumstances beyond Academy’s reasonable control, including hurricanes, severe weather, natural disasters, fire, flood, public health emergencies, governmental orders, facility closures, utility or technology outages, transportation disruptions, labor interruptions, acts of terrorism, civil unrest, or other similar events.
When reasonably practicable, Academy may respond to such an event by rescheduling sessions, using an alternate facility, adjusting dates or hours, providing make-up opportunities, or otherwise modifying program operations. A temporary interruption or modification caused by such an event does not automatically entitle the Parent/Guardian to a refund or cancellation of payment obligations for the purchased service, except as required by applicable law or expressly agreed to by Academy in writing. If Academy permanently cancels a material portion of paid services and provides no reasonable substitute, credit, or make-up opportunity, any refund or credit will be handled in accordance with applicable law and Academy’s written policies.
8. Governing Law; Venue; Severability
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action arising out of or relating to this Agreement or the student-athlete’s participation in the Activities shall be brought exclusively in a state court of competent jurisdiction located in the county where Academy’s principal place of business is located, or such other Florida county as Academy may designate in a separate written agreement, and the parties consent to such jurisdiction and venue.
If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law. This Agreement is intended to be as broad and inclusive as permitted by Florida law.
9. Mandatory Arbitration
Any dispute, claim, or controversy arising out of or relating to this Agreement, the student-athlete’s participation in the Activities, or the relationship between the parties, whether based in contract, tort, statute, or otherwise, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its then-current Consumer Arbitration Rules, before a single arbitrator located in the county where Academy’s principal place of business is located. The arbitrator shall have the authority to award the same remedies, including damages and attorneys’ fees and costs as permitted by law.
The Parent/Guardian and Academy further agree that any arbitration shall proceed only on an individual basis and not as a class, collective, or representative action, and that the arbitrator shall have no authority to consolidate claims of other individuals or to preside over any form of class, collective, or representative proceeding.
10. Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, IF FOR ANY REASON A DISPUTE DESCRIBED IN SECTION 9 IS NOT SUBJECT TO ARBITRATION OR IS OTHERWISE BROUGHT OR PERMITTED TO PROCEED IN COURT, THE PARENT/GUARDIAN AND ACADEMY EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE STUDENT-ATHLETE’S PARTICIPATION IN THE ACTIVITIES. EACH PARTY ACKNOWLEDGES THAT THIS WAIVER IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY TO ENTER INTO THIS AGREEMENT.
11. Entire Agreement; Legal Expenses
This document, together with any written booking terms, addendum, or amendment signed or electronically accepted by the parties, represents the entire agreement between the parties regarding the student-athlete’s participation in the Activities provided by QDBP Academy LLC. Any changes must be made in writing and approved by QDBP Academy LLC. To the extent permitted by law, the prevailing party in any dispute regarding this Agreement may recover reasonable legal costs and fees.
12. Electronic Signature Agreement
The parties agree that electronic signatures, including signatures completed through DocuSign, have the same effect as original handwritten signatures. The Parent/Guardian agrees that this Agreement may be signed electronically and delivered electronically.
13. Electronic and Operational Communications
The Parent/Guardian authorizes Academy to send lesson, package, bundle, schedule, attendance, payment, safety, transportation, emergency, document, and other operational communications using the email address, mobile number, telephone number, or electronic platform provided by the Parent/Guardian. The Parent/Guardian agrees to keep all contact information current and understands that message and data rates may apply to text messages.
Operational notices sent to the contact information provided by the Parent/Guardian may be relied upon by Academy as delivered when sent, except where applicable law requires a different method of notice. This paragraph does not constitute consent to receive marketing or promotional text messages where separate consent is required by law.
YOU ARE AGREEING THAT, EVEN IF QDBP ACADEMY LLC USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM QDBP ACADEMY LLC IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND QDBP ACADEMY LLC HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
16. Participation Period and Renewal
The participation period begins at signing and ends 12 calendar months later at the recorded expiry time. A February 29 anniversary falls on February 28 in a non-leap year. The period is limited to the named minor player and covered Academy Lessons, individual practices, packages, and bundles actually provided, sponsored, organized, or approved by QDBP Academy LLC. It does not include annual or full-term Academy enrollment or activities provided solely by another legal entity. A later purchase of a covered service does not restart this period. Each purchase remains subject to its own included sessions, payment terms, expiration terms, and confirmed reservation requirements.
This period controls eligibility for the purchased participation; it does not erase historical signed records, undo releases for past covered activities, or change the separate media release’s provisions concerning previously captured material. The transportation authorization applies whenever Academy provides, coordinates, or approves transportation in connection with the purchased Activities.

18 and older · Adult participant waiver
This Participation Agreement covers purchased Academy Lessons, individual practices, packages, and bundles provided by QDBP Academy LLC ("Academy"). Covered Activities are limited to the baseball instruction, practices, conditioning, use of fields, facilities and equipment, and related Academy activities provided to the named adult Participant through separately purchased Academy services. The Participant must be at least 18 years old and sign personally. This Agreement does not cover annual or full-term Academy enrollment, which requires separate agreements, or activities provided by Quick Development Baseball Players Inc.
THIS IS NOT ACADEMY ENROLLMENT. Signing this waiver does not provide free entry, membership, an annual or full-term place, or a guaranteed session. Participation requires the purchase of the applicable individual lesson, practice, package, or bundle and a confirmed reservation. This waiver creates no annual tuition commitment, full-term enrollment obligation, or automatic renewal.
1. Acknowledgment of Risks and Assumption of Risk
The Participant acknowledges that participation in purchased Academy Lessons, individual baseball practices, training, conditioning, and related activities included in the purchased lesson, package, or bundle provided by Academy (collectively, the "Activities") involves inherent and other risks that may result in serious bodily injury, illness, permanent disability, paralysis, emotional distress, property damage, or death.
The Participant understands that these risks may arise from known or unknown causes and may occur despite the use of reasonable care, supervision, instruction, equipment, and safety precautions. The Participant knowingly and voluntarily assumes all risks of injury, loss, damage, or death arising out of or related to the Participant’s participation in the Activities.
2. Release, Waiver, Hold Harmless, and Indemnification
The Participant understands the inherent risks associated with athletic participation and releases QDBP ACADEMY LLC, its owners, coaches, employees, and affiliates from liability to the fullest extent permitted by Florida law.
In consideration for permitting the Participant to participate in the Activities, the Participant releases, waives, discharges, and covenants not to sue QDBP ACADEMY LLC, its directors, officers, owners, members, managers, employees, coaches, trainers, instructors, volunteers, agents, representatives, independent contractors, sponsors, facility owners/operators, affiliates, successors, and assigns (the "Released Parties") from claims arising out of or related to the Activities and/or the inherent risks of the Activities, including personal injury, illness, death, or property damage, to the fullest extent permitted by Florida law. This release is intended to waive no more than the claims the Participant may lawfully waive and is not intended to waive claims based on conduct or conditions that are not legally waivable.
The Participant further agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees and costs, arising out of or related to (a) the Participant’s participation in the Activities, (b) any act or omission of the Participant, or (c) any claim brought by the Participant or any third party arising from the Participant’s participation in the Activities, except to the extent caused by the gross negligence or intentional misconduct of a Released Party.
3. Transportation Authorization and Release
The Participant authorizes transportation of the Participant to, from, and in connection with the purchased Activities covered by this Agreement by Academy, its coaches, staff, volunteers, independent contractors, team representatives, or other authorized drivers, or by other persons designated or approved by Academy. The Participant understands that transportation may occur in privately owned vehicles, rental vehicles, vans, buses, or other forms of transportation not owned or controlled by Academy.
The Participant understands and agrees that the Participant remains responsible for timely arrival and departure unless alternate transportation is specifically arranged, and agrees to provide Academy with current emergency contact information and any medical, behavioral, or safety information relevant to the Participant’s transportation and participation.
4. Medical Authorization and Emergency Care Consent
The Participant certifies that the Participant is physically able to participate in the Activities or that any restrictions have been disclosed in writing to Academy. The Participant understands that Academy does not provide medical insurance for the Participant and that the Participant is solely responsible for obtaining and maintaining health, accident, and hospitalization insurance for the Participant.
In the event of illness, injury, accident, or medical emergency involving the Participant, the Participant authorizes Academy and its coaches, staff, agents, or representatives to obtain emergency medical care for the Participant, including first aid, emergency transport, medical treatment, hospitalization, anesthesia, imaging, laboratory testing, and other treatment deemed reasonably necessary by licensed medical personnel. The Participant understands and agrees that all costs associated with such medical care shall be the Participant’s sole responsibility, and releases and holds harmless the Released Parties from any claim arising out of the rendering or failure to render such emergency care, except to the extent caused by gross negligence or intentional misconduct of Academy.
5. Photo / Video / Media Release
The Participant grants Academy and its designees the irrevocable right and permission to photograph, film, videotape, record, livestream, and otherwise capture the Participant’s name, image, voice, likeness, performance, and appearance in connection with the Activities, and to use, reproduce, edit, publish, display, distribute, transmit, and otherwise exploit such materials, in whole or in part, in any medium now known or later developed, including social media, websites, advertisements, promotional materials, brochures, sponsorship materials, and fundraising materials, without further notice, consent, compensation, or approval.
The Participant understands that such materials shall be the sole property of Academy and waives any right to inspect or approve the finished product or the specific use to which it may be applied. The Participant releases and holds harmless the Released Parties from any claim arising out of the use of such photographs, recordings, or likeness, including claims for invasion of privacy, defamation, right of publicity, or emotional distress, except to the extent prohibited by law.
6. Insurance; No Guarantee of Supervision or Outcome
The Participant understands that Academy may not provide one-on-one supervision at all times and that participation in the Activities does not guarantee athletic improvement, playing time, roster placement, tournament participation, exposure opportunities, scholarships, recruitment outcomes, or any other specific result. The Participant acknowledges that the Participant is solely responsible for maintaining appropriate medical, accident, and liability insurance coverage for the Participant.
A temporary interruption or modification caused by such an event does not automatically entitle the Participant to a refund or cancellation of payment obligations for the purchased service, except as required by applicable law or expressly agreed to by Academy in writing.
Any legal action arising out of or relating to this Agreement or the Participant’s participation in the Activities shall be brought exclusively in a state court of competent jurisdiction located in the county where Academy’s principal place of business is located, or such other Florida county as Academy may designate in a separate written agreement, and the parties consent to such jurisdiction and venue.
Any dispute, claim, or controversy arising out of or relating to this Agreement, the Participant’s participation in the Activities, or the relationship between the parties, whether based in contract, tort, statute, or otherwise, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its then-current Consumer Arbitration Rules, before a single arbitrator located in the county where Academy’s principal place of business is located. The arbitrator shall have the authority to award the same remedies, including damages and attorneys’ fees and costs as permitted by law.
The Participant and Academy further agree that any arbitration shall proceed only on an individual basis and not as a class, collective, or representative action, and that the arbitrator shall have no authority to consolidate claims of other individuals or to preside over any form of class, collective, or representative proceeding.
10. Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, IF FOR ANY REASON A DISPUTE DESCRIBED IN SECTION 9 IS NOT SUBJECT TO ARBITRATION OR IS OTHERWISE BROUGHT OR PERMITTED TO PROCEED IN COURT, THE PARTICIPANT AND ACADEMY EACH KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE PARTICIPANT’S PARTICIPATION IN THE ACTIVITIES. EACH PARTY ACKNOWLEDGES THAT THIS WAIVER IS A MATERIAL INDUCEMENT FOR THE OTHER PARTY TO ENTER INTO THIS AGREEMENT.
11. Entire Agreement; Legal Expenses
This document, together with any written booking terms, addendum, or amendment signed or electronically accepted by the parties, represents the entire agreement between the parties regarding the Participant’s participation in the Activities provided by QDBP Academy LLC.
The Participant agrees that this Agreement may be signed electronically and delivered electronically.
13. Electronic and Operational Communications
The Participant authorizes Academy to send lesson, package, bundle, schedule, attendance, payment, safety, transportation, emergency, document, and other operational communications using the email address, mobile number, telephone number, or electronic platform provided by the Participant. The Participant agrees to keep all contact information current and understands that message and data rates may apply to text messages.
Operational notices sent to the contact information provided by the Participant may be relied upon by Academy as delivered when sent, except where applicable law requires a different method of notice. This paragraph does not constitute consent to receive marketing or promotional text messages where separate consent is required by law.
14. Acknowledgment and Electronic Signature
The Participant certifies that the Participant is at least 18 years old, has carefully read this entire Agreement, fully understands its contents, has had the opportunity to review or discuss this Agreement with legal counsel, and signs it freely and voluntarily. The Participant understands that this Agreement includes a release of liability, waiver of claims, assumption of risk, indemnification obligations, transportation authorization, emergency medical consent, media release, payment obligations for purchased services, force majeure provisions, and electronic and operational communications terms, and that it is intended to be legally binding to the fullest extent permitted by Florida law.
15. Participation Period and Renewal
The participation period begins at signing and ends 12 calendar months later at the recorded expiry time. A February 29 anniversary falls on February 28 in a non-leap year. The period is limited to the named adult Participant and covered Academy Lessons, individual practices, packages, and bundles actually provided, sponsored, organized, or approved by QDBP Academy LLC. It does not include annual or full-term Academy enrollment or activities provided solely by another legal entity. A later purchase of a covered service does not restart this period. Each purchase remains subject to its own included sessions, payment terms, expiration terms, and confirmed reservation requirements.
A new acknowledgement is required when this period expires, the Participant's identity changes, the applicable terms change, or the identity of the activity provider changes. Updating contact or emergency contact details alone does not renew or invalidate this acknowledgement. The record must be current on the date of participation.
I certify that I am the named Participant, I am at least 18 years old, and I have read this entire adult participation agreement, understand its contents, and sign it freely and voluntarily. I consent to using my typed full name as my electronic signature and to receiving a downloadable electronic copy.
Use only the agreement required for your selected service. A mixed Academy and Facility service may require both applicable agreements for the same participant.
Website terms for both businesses
These terms address this shared website for Quick Development Baseball Players Inc and QDBP ACADEMY, LLC (the Businesses). Quick Development Baseball Players Inc is the provider named in the baseball/facility participation waiver. Academy enrollment is with QDBP ACADEMY, LLC under its separate contract. A shared website does not merge the Businesses or make either a guarantor of the other’s obligations. Your service agreement identifies the responsible provider.
QDBP Academy app
The private app is for authorized Academy administration. Only the authorized owner may connect Gmail and approve messages. Its use does not change a family’s enrollment, tuition or service agreement.
Authorized use and materials
Provide accurate information and register only players for whom you have authority to act. Protect your sign-in access. Do not impersonate others, access another family’s records, disrupt this website or submit malicious content. Either Business may restrict misuse affecting its services, subject to applicable law and existing agreements. Names, logos, photographs and materials belong to the relevant Business or their respective rights holders; browsing does not grant commercial reuse rights.
Registration and separate agreements
Registration is not Academy enrollment, a confirmed appointment or a payment. A participation release applies only to its named parties, activities and stated scope. Media permission and transportation authorization are mandatory parts of the participation agreement. Academy tuition and enrollment require the Academy agreement. These website terms do not silently amend existing signed service agreements.
Cancellation and refund policy
Facility appointments require at least two hours of notice to cancel or reschedule. No-shows are non-refundable. Academy and camp registration fees are non-refundable. Academy enrollment terms are handled separately and privately with each family.
Participation agreement status
New acknowledgements signed through this website are official participation records for Quick Development Baseball Players Inc and remain current for 12 calendar months, subject to the renewal terms. Historical records marked REVIEW ONLY remain review records and must be replaced with a new official signature. Online Acuity booking and payment activation are separate from signing this agreement.
External services and limitations
Acuity, payment providers and the linked merchandise seller operate under their own applicable terms. Neither Business guarantees uninterrupted website access, availability of an outside service, or a particular athletic or educational result. To the extent permitted by applicable law, neither Business is responsible for losses caused by unauthorized misuse or third-party services outside its control. Nothing here excuses either Business’s own legally actionable conduct, waives nonwaivable consumer or privacy rights, or releases a minor’s injury claims. Participation releases must be separately presented and accepted as required by law.
Law, changes and contact
Florida law governs these website terms to the extent consistent with mandatory applicable law. An unenforceable provision does not displace the remaining lawful provisions. Material changes to signed participation terms require new acceptance; historical records are preserved. Terms updated September 11, 2026. Contact Quick Development Baseball Players Inc at quickdbp1@gmail.com or QDBP ACADEMY, LLC at quickdbpacademy@gmail.com. Read the privacy notice for information handling and requests.
